Our presiding Juvenile Court Judge of San Diego County has worked tirelessly to give caregivers access to filing court forms electronically. Caregiver Information, DeFacto and Prospective Adoptive Parents are the legal forms caregivers have the right to file with the court before hearings. Please try and get your paperwork to the court a week in advance of your court date so that it can be distributed to all parties in the case. If you are too late you run the risk of it not being filed on time.

CAREGIVER INFORMATION FORM JV-290
Foster parents have not always had the right to attend court hearings or submit reports to the court concerning the children placed in their homes. The Caregiver Information Form or JV-290, was created to give caregivers the ability to give information about their foster children directly to the judge. All foster parents have the right to "be noticed" and "be heard" in hearings for their foster children.

These forms are filled out by the caregiver when requesting De facto Parent Status from the judge. De facto Parent Status gives foster parents elevated procedural rights in the court hearings such as being able to have an attorney represent them, calling witnesses and cross examining witnesses. Caregivers must file a petition with the court requesting De Facto status to be granted. The judge will have a hearing and decide if the status will be given or not.

PROSPECTIVE ADOPTIVE PARENT FORMS JV-321 JV-322
Foster parents who want to adopt their foster child may ask the court to grant them "Prospective Adoptive Parent" status. The rights of the child must be terminated. If a foster parent has been granted the status or is eligible to have been granted the status, the agency may not remove the child until the foster parent has an opportunity to ask the judge to review the case.
